What these terms cover

These Terms of Use (“Terms”) govern your access to and use of aqmauditing.com (the “Site”). They are an agreement between you and American Quality Management (“AQM,” “we,” “us”).

These Terms do not govern consulting engagements between AQM and clients. Every AQM engagement is performed under a separate, signed services agreement that controls scope, deliverables, fees, confidentiality, indemnification, and warranties for that engagement. If anything in these Terms conflicts with the signed services agreement, the signed services agreement controls.

By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

Permitted use

You may use the Site to learn about AQM’s services, to contact us, and for any other personal or business research purpose. You agree not to:

  • Use the Site in any way that violates US, state, or local law.
  • Attempt to gain unauthorized access to any part of the Site, the underlying server, or any data not intended for public access.
  • Interfere with the Site’s operation (for example, by overwhelming forms, scraping at a volume that affects performance, or attempting to deliver malware).
  • Use automated tools to collect content from the Site for purposes that would compete with AQM’s business, without prior written permission.
  • Misrepresent your identity or your authority to act on behalf of an organization.

Site content and intellectual property

The content on the Site — including text, layout, design, logos, photographs, and the proprietary structure of pages — is owned by AQM or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.

You may:

  • View pages in your browser.
  • Print or save individual pages for your own personal or internal business reference.
  • Share links to public pages.

You may not, without AQM’s prior written permission:

  • Republish, redistribute, or sell Site content.
  • Use AQM’s name, logo, or marks in a way that implies endorsement or partnership where none exists.
  • Use Site content to train commercial generative-AI models or to populate competing service marketing.

Third-party trademarks referenced on the Site — including standards-body marks (ISO, AS9100, Nadcap, and others) — remain the property of their respective owners. Reference to those standards does not imply endorsement by, or partnership with, the standards bodies themselves except where AQM holds a credential or registration that we describe specifically.

Information accuracy and “no advice” disclaimer

We work to keep the Site accurate. We can’t guarantee it. Standards bodies revise their standards. Regulatory expectations change. Our service offering evolves. Read what’s on the Site as a starting point for a conversation, not as a substitute for advice tailored to your situation.

Nothing on the Site constitutes a binding offer of services, a guarantee of outcome (including certification, audit results, or supplier qualification), or legal advice. Project scope, fees, timelines, and deliverables are quoted only in writing and only after an initial scoping conversation.

Third-party links

The Site may link to third-party websites (for example, accreditation-body pages, standards documents, or vendor profiles) for your convenience. We don’t control those sites and we’re not responsible for their content, practices, or policies. Visiting a third-party site is at your own risk and is governed by that site’s own terms.

Disclaimer of warranties

The Site is provided “as is” and “as available.” To the maximum extent permitted by law, AQM disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We don’t warrant that the Site, its servers, or any communications sent from us are free of viruses or other harmful components.

This disclaimer applies only to the Site. Warranties applicable to consulting work are set in the signed services agreement for that engagement.

Limitation of liability

To the maximum extent permitted by law, AQM, its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Site — even if AQM has been advised of the possibility of such damages.

Where a jurisdiction does not allow exclusion of certain damages, AQM’s total aggregate liability for any claim related to the Site is limited to one hundred US dollars (US $100).

Again, this limitation applies only to the Site. The signed services agreement controls AQM’s liability for consulting work.

Indemnification

You agree to indemnify and hold AQM harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your violation of these Terms, (b) your misuse of the Site, or (c) your violation of any law or third-party right in connection with your use of the Site.

Changes to these Terms

We may update these Terms at any time by posting a revised version here. The “Last updated” date at the top of the page reflects the most recent change. Continued use of the Site after a change constitutes acceptance of the revised Terms.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms or the Site is the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms — together with the Privacy Policy and any other policies linked from the Site — constitute the entire agreement between you and AQM regarding your use of the Site.
